Job Overview: A law firm based in Austin, TX, seeks a highly skilled and experienced Senior Advertising Marketing and Promotions Attorney. This role requires a deep understanding of advertising law, consumer protection law, and marketing transactions. The ideal candidate will handle various legal matters related to advertising and marketing, including drafting and negotiating agreements, providing legal counsel, and ensuring compliance with relevant regulations.

Duties and Responsibilities:

• Draft and negotiate agreements for ad agencies, influencers, celebrity endorsements, sponsorships, online media buying, and other marketing and promotion activities.
• Review and analyze advertising copy for issues related to false advertising, claim substantiation, intellectual property, and right of publicity.
• Counsel clients on compliance with regulations concerning contests, sweepstakes, price advertising, recurring subscription programs, and loyalty/rewards programs.
• Provide legal advice and strategy on false advertising, unfair competition, and National Advertising Division (NAD) disputes.
• Work collaboratively with clients and internal teams to develop and implement effective marketing and promotional strategies.
• Maintain up-to-date knowledge of industry trends, regulatory changes, and emerging legal issues in advertising and marketing.
• Draft, review, and provide feedback on legal documents, communications, and marketing materials.

Requirements:

• Juris Doctor (JD) degree from an accredited law school.
• Admission to the Texas State Bar or eligibility for admission.
• Extensive experience in advertising law, consumer protection law, and marketing transactions.
• Proven track record in drafting and negotiating complex marketing and promotion agreements.
• Experience with false advertising, unfair competition, and NAD dispute resolution is preferred.
• Strong attention to detail and the ability to work effectively within a team environment.
• Excellent academic credentials and outstanding legal writing and communication skills.
• Experience in a large or medium-sized law firm setting is preferred.
